Wisconsin Supreme Court Makes GOP DecisionDrawn Legislative Cards

MADISON, Wisconsin (AP) – Wisconsin Supreme Court on Friday passed Republican drawn cards for State Legislature, handing the Republican Party victory just weeks after initial card approval drawn Democratic Governor Tony Evers.

The court overturned its decision after the U.S. Supreme Court in March said the Evers cards were taken wrong, and came just as the candidates were going begin distribution of nomination papers on it’s a year newsletter without being sure of county boundaries.

Democrats would made some marginal gains from the Evers plan, but the Republicans were predicted to retain their majority in Assembly and Senate, according to the analysis of the governor’s office.

The Wisconsin Supreme Court accepted the Evers card. on March 3, but the US Supreme Court overturned it on March 23. The Supreme Court ruled that the Evers map failed consider whether therace- a neutral alternative that does not add seventh majority -black the district will deny black voters equal political opportunity”.

Evers told the State Supreme Court he can still accept his card with some additional analysis or alternative with six most are black areas. The Republican-controlled Legislature claimed that its map should be implemented.

Wisconsin court, controlled 4:3 by conservatives, sided with Legislature.

“The cards proposed by the Governor… are racially motivated and, in accordance with the Equal Protection Clause fail strict scrutiny,” wrote Chief Justice Annette Ziegler. for majority, joined Judges Patience Roggensack, Rebecca Grassle Bradley and Brian Hagedorn.

Maps of the Legislative Assembly, they wrote, race neutral” and “observes with the equal protection clause, and with all other federal and state legal requirements”.

Hagedorn, and conservative rock justice originally backed the Evers card but changed his mind once it came to back before the court. In a separate consent, he wrote that the U.S. Supreme Court decision required state court to accept raceis a neutral card, and the Legislative Assembly cards “are the only legally compliant cards we have received.”

Three liberal courts justices Jill Karofsky, Ann Walsh Bradley and Rebecca Dallet disagreed. Karofsky, writing for a minority, said that the Legislative Assembly cards “are no better than the Governor’s cards according to the U.S. Supreme Court’s rationale.”

“If, in the opinion of the U.S. Supreme Court, the addition of a governor of Milwaukeearea majority-minority district demonstrates disqualifying consideration of racethen removal of the Legislative Assembly of Milwaukeearea Majority-minority county identifies equally suspect, if not more flagrant, sign of race based on line drawing,” wrote Karofsky.

Assembly Speaker Robin Vos praised for ruling stating that the Republicans “thought our cards were best option at first.”

Evers named decision “outrageous” and said the court backed down on an earlier finding that Legislative Assembly cards illegally collected black voters in order to reduce their vote power.

“At a time when our democracy is under almost constant attack, the judiciary has abandoned our democracy in our worst hour,” Evers said.

Republicans have a majority 61-38 in Assembly and advantage 21-12 in Senate. Even under the GOP card, which the state court initially rejected, they were not expected to win a supermajority that could override any Evers veto.

US Supreme Court decision in the Wisconsin case marked first the time of this redistricting cycle when he flipped the cards drawn state.

The court made it clear that it could significantly change the grounds rules which govern the redistribution of districts. The court’s involvement stems from its 2019 ruling that federal courts have no role in suppression of guerrilla machinations.

In February, it stopped the ruling panel of federal judges demand that Alabama redraw its maps to give Black people best chance to choose their representatives by saying it can need revisit the long-standing case law that governs this. It’s case law cited by the high court in Wisconsin ruling.

Court declined block cards in North Carolina and Pennsylvania. But four conservative justices wrote that they want to rule on in novel legal theory that state legislatures, not state courts, have the highest power in card drawing.

Although the U.S. Supreme Court rejected Wisconsin’s legislative maps, it accepted Evers’ proposed congressional maps. Republicans currently keep five of eight state locations. This card made one of these GOP districts more competitive.

Redistribution is a process of redrawing political boundaries based on on in latest census. Mappers can create an advantage for their political party packing opponents into multiple districts or distributing them across multiple districts, a process known as fraud.
