LAHORE:
Lahore High Court division bench, chaired by Justice Shujaat Ali Khan, upheld the LHC head of justice in a decree that allowed Punjab Assembly Deputy Speaker Sardar Dost Muhammad Mazari to lead session for elections of scheduled meeting of the chief minister on 16 April.
This is second the time when PA speaker Chaudhry Pervez Elahi and the secretariat lost their legal battle against deputy speaker.
Earlier, LHC Chief Justice Muhammad Amir Bhatti ordered Mazari to proceed with the election CM in terms of subclause (3) of Article 130 of Constitution. This order was issued on Mazar’s petition against Speaker of Elahi who according to him, withdrew his powers as acting speaker.
As LHC Chief Justice Muhammad Amir Bhatti set towards the order by which powers of the deputy speaker was recalled, the speaker of Elahi and the PA secretariat appealed the verdict.
LHC this time division bench led by Judge Shujaat Ali Khan and composed of Judge Javad Hasan heard the case in detail.
Friday, when the trial began, division benchx head Judge Shujaat was in charge of the Inspector General of Police (IGP) Punjab, who attended in courtroom to review the SOP and ensure complete security on election day and no members of the assembly is prohibited from entering the premises of the assembly.
Meanwhile Judge Shujaat also sent the chief of the Punjab secretary coordinate with IGP and ensure smooth process on election Day.

Arguments of adviсe of Elahi and the PA secretariat revolved around “bias”.
At the beginning of arguments, Mazari reported bench that his powers of the deputy speaker was recalled and the meeting was made “don’t go area”. He told the court that he had never witnessed such practice even under a dictatorship.
