ISLAMABAD: Aisha Nawaz, defector MP of Pakistan Tehreek-e-Insaf (PTI) in Punjab Assembly who voted for Vice President of Pakistan Muslim League-Nawaz (PML-N) Hamza Shehbaz during elections for in office of The chief minister applied to the Supreme Court against its withdrawal from notification by the election commission of Pakistan (ECP) on accusations of floor-intersection.
Nawaz is one of 25 deputies in Punjab Assembly of PTI who deserted and voted for Shehbaz in in elections on April 16. Commission officially de-notification of deputies on May 23 under Article 63-A of Constitution.
Article 63-A provides that deputies who the defect may lose its place if they are then vote against their party government seeks to find out whether also applied before they throw their votes.
It says that the deputy can be disqualified. on grounds of desertion if theyvote or abstain from voting in House in spite of anyone direction issued by Parliament party to which it belongs in attitude towards elections of in prime minister or boss minister; or vote of confidence or vote of no-confidence; or money bill (budget) or a bill to amend the Constitution.”
Nawaz on Wednesday has become second disqualified member of parliament after Zahra Batul – mother of PTI MP Basit Sultan Bukhari, also defector – to move to the Supreme Court with a request to annul the ESP decision, claiming to decision breaks the law.
“EKP violated the principles laid down down in in decisions of Supreme Court,” she said, adding a statement of in party the leader was not in conformity with law.
In its resolution on On May 17, the Supreme Court announced this. votes Cast against party direction cannot be counted and should be ignored. He said that with link to parliament, fundamental rights of political parties have supplanted rights of individual legislators.
“EKP decision did not distinguish between posts of in party leader and head of parliament,” Nawaz said.

“PTI is not issue show-cause notice in accordance with the law,” she argued and added that according to the law issuance of a show-cause notice was required.

With these 25 legislators are no longer members of assembly, Shahbaz, who won for Main minister with in help of dissident legislators, lost his meager majority in Assembly of the Punjab, raising questions about the status of his government.
Shehbaz got 197 votes in Chief minister election but now left with in support of 172 members in in house. The candidate needs support of at least 186 deputies in The 371-member House of Representatives will elected as chief minister.
