PTI file petition in Supreme Court

ISLAMABAD: PTI on Wednesday applied for in The Supreme Court, seeking leave of the court before announcement of another long trek to Islamabad.

PTI Chairman Imran Khan said that party go to the supreme court for assurances that their workers and supervisors will not be arrested, but party protests will be allowed in federal capital.

Speaking outside The Supreme Court today, PTI leader Asad Umar said they have filed a petition and put nine questions before the high court.

In its petition, PTI pleaded with court to instruct the authorities not to torture or arrest or use Any force or coercive measures or intimidating tactics, against townspeople of Pakistan and supporters, workers, members and leaders of in public who want peacefully hold any protest or assembly announced this.

He requested the court that the federal and provincial governments be ordered not to create any obstruction or impediment, including blocking access to or from any place or city in in any way or from restricting movement of in people in in any way and by any means.

it also pleaded with the higher authority issue directives government not use violence, including force or any strong weapon tactics against any citizen, supporter, worker, member or leader of in party who decides to participate in upcoming peace meeting.

Issues raised in PTI petition

  1. Be freedom of movement, as well as the right to peaceful protest and procession is a fundamental right of all citizens of Pakistan under the constitution of Islamic Republic of Pakistan 1973 (hereinafter “Constitution”)?
  2. Whether constitutional rights enshrined in Articles 4, 5, 8, 9, 10, 14, 15, 16, 17, 19 and 25 of Constitutions, may be unreasonably restricted by executive authorities, by use of disproportionate and illegal force on civilians?
  3. Whether the basic rights enshrined in Articles 8, 9, 10, 14, 15, 16, 17, 19 and 25 of Should the constitution be respected and protected from unconstitutional and illegal cuts by state bodies?
  4. Whether it be the state and government agencies of Pakistan may illegally deprive citizens of their freedom guaranteed by Articles 9 and 10 of constitution, arresting people who participate in or intend to participate in a peaceful protest for achievement of their democratic rights?
  5. Can public authorities, without any cause or reason to intimidate, intimidate or cause physical harm to individuals and groups who gather for peaceful procession, thereby violating their “inviolable” dignity and privacy of homeas guaranteed by article 14 of Constitution?
  6. Whether it be citizens of Pakistan has the right to peacefully enter, move around and remain in various territory of Pakistan, in conformity with Article 15 of Constitution?
  7. Do citizens have the right to peacefully assemble, protest and demonstrate, for in achievement of their democratic demands, in conformity with letter and spirit of Article 16 of Constitution?
  8. Whether a petitioner, a duly registered political party, has the fundamental right to organize, unite and hold a nationwide political rally, in conformity with Article 17 of Constitution, without unlawful interference from the federal and provincial government authorities?
  9. Whether arrest as well as detention of members of in a petitioner political party before or during a peacefully organized protest, amount illegal detention as well as arrest also violation of plaintiff’s rights under article 17 of Constitution?
