KARACHI: Although some lawyers believe that PTI Chairman Imran Khan should apologize for his comments against female judge, others claim he will find hard stand the accusation despite the apology.
Shahzeb Khanzada said this in Geo News Program Aaj Shahzeb Khanzada Kay Sat. He said the notice said that Imran’s remarks were made with motive of “undermining the integrity and credibility of judicial system in in eyes of public on the loose.”
Shahzeb said Contempt of A 2003 court ruling defines contempt of court as (a) civil contempt (“willful disregard or disregard for of (i) an order, provisional or final sentence or ruling of court (ii) a court order or an order issued by a court in an exercise of its constitutional jurisdiction (iii) obligation given to the court and recorded by the court (iv) process of court.”), (b) criminal contempt (deed of any action with intention or presence effect of obstruction of administration of justice.”) and (c) contempt of court (“scandal of judgment and includes personal criticism of referee holding office.”)
He said that criminal contempt is considered serious and Imran’s statement may attract this item of resolution. Shahzeb said the courts are usually lenient with civil and judicial contempt of court, but chances of conviction under criminal contempt higher.
He said Retired Judge Shah Khawar, Retired Judge Nasira Javed Iqbal and Retired Judge Rashid A. Razvi advised Imran to offer an unconditional apology, while noting that even minor penalty deprive him of his right for five years.
On the contrary, Shahzeb said, Fawad Chaudhry said that Imran would challenge his case. instead of making an apology.
Shahzeb said that Imran Khan was critical of judicial magistrate Zeba Chaudhry and stated that torture had been proven. in court. Shahzeb said she was not provided with any medical report while the Supreme Court ordered an investigation into allegations of torture.
