The judge sends back petitions challenging Punjab CM elections in the LHC boss

LAHORE: Lahore High Court (LHC) Judge Shujaat Ali Khan on Monday posted set of petitions against elections of Hamza Shehbaz – Chief of the Punjab minister back to the boss justice.

Judge Khan heard set of petitions for annulment of elections of Chief Minister Shehbaz.

Azhar Siddiq said during the hearing that the case was almost over. in court of Chief Justice Amir Bhatti, but the files were instead sent to this court.

Judge Khan noticed that there was no order available regarding the transfer of files. Thus, the judge returned petitions filed by Pakistan Tehreek-e-Insaf (PTI), Punjab Assembly Speaker Perwaiz Elahi, Munir Ahmad and others. back to Judge Bhatti.

The Chief Justice heard the motions against Shehbaz. The applicants submitted that, following the interpretation of the Supreme Court of Article 63-A, Shahbaz lost his constitutional right to remain in power and asked the court to remove him from deduction office since he lost most in provincial assembly.

The Court was asked to declare all the measures and actions taken by the acting head minister as “illegal and unconstitutional”.

At the May 30 meeting of case, Justice Bhatti noted that the summary ruling of the Supreme Court stated that votes of dissidents will not be counted if the vote is still in progress.

“If we apply this order on past cases, this means that all decisions will be canceled,” said CJ Bhatti.

Chief Minister Shehbaz also presented his 16-page reply to court on May 23 in whom he insisted that his election be held in conformity with in rules and constitution of country.

He believed that the elections for Main minister was carried out before interpretation of Article 63-A of the Supreme Court and interpretation did not affect the election.

He also stated that the election-related investigation former the governor was illegitimate, and the Punjab Assembly secretary also had no jurisdiction to inquire into the election.

Shahbaz asked the court to reject the petitions against his election after the imposition of a fine on petitioners.
