The IHC declares the PECA ruling null and void and void

ISLAMABAD: Islamabad High Court (IHC) on Friday announced Warning of The Electronic Crime Act (PECA) regulation is void and void, ARY News reported.

IHC single bench as part of Chief Justice Athar Minallah announced four page judgment on petitions filed by PBA, PFUJ and others against PECA decision.

“Prevention of The Electronic Crime Act (PECA) Ordinance of 2022 and its promulgation has been declared unconstitutional, invalid beyond a reasonable doubt, and therefore repealed. down”, read the verdict.

The court denied all applications against PECA decision. PBA in This plea argued that the ruling was issued to encourage self-censorship and the president must have a good reason before issuing any ruling.

It should be mentioned here that the IHC held hearings on a plea against Electronic Crime Prevention Act (PECA) Amendment Ordinance 2022

At a previous hearing, Attorney General Khalid Javed Khan told the court that government ready to take back Pakistan Electronic Crime Act (Amendment) (PECA).

Attorney General Khalid Javed told the court that the case could be sent back to the federal cabinet for an opinion of in concerned persons.

“The resolution intended to introduce in National Assembly or Senate. Not required to produce in in house where you have the majority,” said Judge Athar Minallah.

PECA law

Back in February of this yearPresident Arif Alvi ratified the Prevention of The Electronic Crime Act (Peca) and in accordance with the PECA Ordinance, as amended, will be subject to more severe penalties. for fake news news and hate speech content on electronic and social media platforms.

The amended law will also pave way for action over hate speech and fake news against in national institutions, including the armed forces and national numbers.
