Republicans try to undermine Jan. 6 committee with false statements

Hours before the House Committee to Investigate the Capitol Riots opens its public hearings, Republican legislators sought to portray panel as illegitimate. AT news conference, they condemned the creation of the committee, its work and speaker Nancy Pelosi with inaccurate statements. Here fact Check.

What was said

“He was caught tampering with evidence, including text messages. of our ranking member Jim Jordan.” — Rep. Kevin McCarthy, Republican of California, in a news conference on Thursday

This is exaggerated. It was a link to a text message presented at the meeting of a special committee investigating the January 6 riots. Text not provided in full but no words have been changed.

During the meeting, Rep. Adam B. Schiff, Democrat of California, read and introduced text that an unnamed MP sent to Mr. Meadows: “January 6, 2021 Vice President Mike Pence as President of Senate should call out all electoral votes which he considers unconstitutional since no elections votes generally.”

Mr. Schiff then claimed that the text message illustrated why it was “so criticalto continue interrogating Mr. Meadows.

A few days later conservative The Federalist reported that the text came from Republican Party spokesman Jim Jordan. of Ohio, who forwarded it to Mr. Meadows; the message originally came from a lawyer claiming that the vice president had the legal authority to revoke the certificate votes.

full the text read: “January 6, 2021 Vice President Mike Pence as President of Senate should call out all electoral votes which he considers unconstitutional since no elections votes generally – in conformity with guidance from the ground father Alexander Hamilton and Judicial Seniority. “No legislation,” wrote Alexander Hamilton. in Federalist No. 78, “contrary to the Constitution, may be valid.” Court in Hubbard v. Low confirmed this truth: “That an unconstitutional statute is not law at all is no longer up for debate.” 226 F. 135, 137 (SDNY 1915), appeal denied, 242 US 654 (1916). Following this explanation, an unconstitutionally appointed elector, like an unconstitutionally adopted law is not a voter at all.”

representative for the committee acknowledged the shortening of the text and apologized for doing so.

What was said

“She rejected the choice of a minority to be on Committee. It happens against 232 years of tradition in this house. You reject the minority opinion in committee.” — Mr McCarthy

FALSE. There are seven Democrats and two Republicans. on an elected committee, contrary to Mr. McCarthy’s claim that it is entirely partisan. Moreover, Mr. McCarthy omits fact that he is partly responsible for in small amount of Republicans are participating. His resurrection of two-century tradition of minority contribution also wrong.

The House passed a resolution creating selection committee in June 2021 grant to Ms. Pelosi power appoint eight members and Mr. McCarthy five. A few weeks later, Mr. McCarthy appointed Representative Jim Banks. of Indiana as a senior member, as well as Mr. Jordan and representatives Rodney Davis. of Illinois, Kelly Armstrong of North Dakota and Troy Nels of Texas.

Ms. Pelosi dismissed Mr. Banks and Mr. Jordan, arguing that the two vocal supporters of Mr. Trump can affect the “honesty of investigation”, but agreed to the participation of three other Republicans. In response, Mr. McCarthy said the Republicans would not participate at all unless Mr. Jordan and Mr. Banks were allowed to join Committee.

Ms. Pelosi later nominated two Republicans critical of Mr. Trump, Reps Liz Cheney of Wyoming and Adam Kinzinger of Illinois.

Moreover, Mr. McCarthy was wrong say Ms. Pelosi broke with two-century tradition, abandoning two of his choice. In fact, the speaker appointed members and chairmen of committees until 1911, and the speaker “retained the right” to appoint members to elected committees, according to the leadership of the MPs of the House of Representatives.

In other words, a minority party did not have role in appointment process for most of american history said Joshua S. Hueder. senior friend and expert in congressional procedures and history at Georgetown University. After 1911 this was rare. for majority party deny the minority partyelections, but Mr. Hooder said: “I know for a fact that they used informal political weight to limit who chosen by the minority.

What was said

Was Speaker Pelosi involved in in decision delay the help of the National Guard on January 6? These are serious and real questions that this committee refuses to even ask. Speaker Pelosi is not want answer these questions because she knows that the answers to these questions leave a mark of bread crumbs right back her office, emphasizing her carelessness, lack of of leadership as a speaker of home.” — Mr Banks, at the same time news conference

It’s a delusion. Per over a yearrepublican and conservative commentators have repeatedly and erroneously accused Ms. Pelosi of for delay in deployment of the National Guard to the Capitol on January 6.

There is no evidence that Ms. Pelosi office declined a request to deploy the National Guard, or even played role in any delays over OK. decision lies with The Capitol Police Board, which includes House and Senate sergeants and the architect of Capitol.

Report of two bipartisan Senate committees investigating the January 6 incident. attack attributed delays in asking the National Guard to conduct “non-transparent processes”. He noted that members of The Capitol Police Department was not familiar with approval process and gave conflicting reports of when help was first asked.
