federal judge on Environment temporarily locked part of Strict Idaho abortion law planned to be enacted effect Thursday, giving the Biden administration a narrow courtroom win in this is first reproductive rights lawsuit after the Supreme Court overturned Roe v. Wade.
U.S. District Judge B. Lynn Winmill ruling prevents Idaho from enforcing new law when it contradicts with Federal guidelines for emergency abortion in hospitals.

Attorney General Merrick Garland announced lawsuit against Idaho this month, arguing that state law is contrary to with federal law known as the Emergency Medical Services and Labor Act, or EMTALA, which was passed in from 1986 to ensure patients receive adequate emergency medical care.

Brad Little responded to a request for comment with Thursday’s statement, which said: “JD Biden’s attempts to target Idaho and intervene in the case is clearly delegated to the state – and the federal judge decision temporarily carving out very narrow exception – do not change fact that the Idaho Life Protection Act, which prohibits selective abortion, moving forward”.
Winmill heard the arguments on Department of Justice request for preliminary injunction on Monday and said he issue written order no later than Wednesday. State law still to be enacted effect Thursday, minus the provision that Winmill said the state could not enforce for currently.
Although the state claimed that its law was not contrary to with EMTALA, Winmill found his argument was not convincing “because he failed correctly take into account for stunningly wide range of his law,” which, he said, “criminalizes all abortions.”
“Impossible to keep with both statutes,” Winmill wrote.[W]here federal law requires a provision of care and state law criminalizes the very care that cannot be observed with both laws. Full stop.”
The Idaho ruling has come just hours after failure for administration in Texas, where a federal judge prohibited the state from enforcing Department guidelines. of Health and Human Services requiring hospitals to perform emergency abortions women.
Garland said the Justice Department did not agree with this ruling and “considers it appropriate next steps”.
Court battles are unfolding like pre-election politics indicate that many voters are likely to make abortion a top priority in November mid-term elections.
