Lahore High Court (LHC) on Friday restored Chaudhry Pervez Elahi – Chief of the Punjab minister and his office on assurances that the provincial assembly would not be dissolved, suspending Governor Baligur Rehman’s de-notification order.
A five-person bench led by Judge Abid Aziz Sheikh, also requested answers from a quarter concerned as well as point of view of governor until January 11, 2023. bench also sent a notice to the prosecutor general for Pakistan and Punjab advocate generalby contacting them for legal assistance.
Governor Rehman issued an order in tiny hours of Friday to de-notify the boss minister and dissolve his cabinet after Elahi did not accept vote of confidence from the provincial assembly to Wednesday by order of the governor on Monday.
Elahi challenged the governor’s order in TANK. During the hearing of The chief minister of the Elahi de-notification case gave the court an assurance in writing that he would not dissolve the provincial assembly if he was reinstated as head minister.
Elahi counsel lawyer Ali Zafar read the commitment in court. “I am Chaudhry Parvez Elahi, Chief Minister Punjab, we pledge that if the governor’s order is suspended and Chief Minister and cabinet restored to my original position, I will not advise the governor dissolve Assembly before next date of rumor,” the statement said.

The court held that the operation of Governor’s order will be carried out in postponement until next date of gossip added that this order does not preclude petitioner from taking vote of confidence on at will. After Elahi’s order, his cabinet was restored until 11 January. next date of hearing.

Barrister Zafar added what a reading of governor’s order of December 19 showed that the grounds based on expected to satisfy did not meet the objective criteria for invoking jurisdiction under section 130(7) of Constitution.

At this point, Judge Sheikh noticed that the governor’s order should be fulfilled with if he [the governor] had required what a boss minister receive vote of confidence. However, Zafar insisted. on reasonable time.
This does not mean that the governor has received up early in morning and pass order to the boss minister for receiving vote of confidencehe objected. Judge Sheikh asked what would be the harm if the chief minister was received vote of confidence.
The court further noted that petitioner Temporary relief may be granted by suspending the governor’s orders and reinstating him in his former position if a commitment is brought before the court that the Punjab Assembly will not be dissolved.
Judge Sheikh noted that bench wanted balance between both sides, emphasizing that it is not want anyone to use its order for wrong purpose. Court made This clear Elahi’s lawyer that temporary assistance will be provided petitioner if he came up with obligation not to dissolve the meeting.
When submitting a commitment of Chief MinisterLawyer Zafar also read before the court. To what lawyer Khalid Ishak, who appeared on on behalf of of defendant, argued that the governor was prepared to withdraw his orders if petitioner took in vote of confidence during the period of seven days.
Lawyer Ishak, who represented the governor without representation power of advocate also claimed that petitioner should also promise that he is not dissolve Assembly during this period. The BAC asked the governor to submit a statement that he was withdrawing his order.
Five judges bench The panel was composed of Judge Abid Aziz Sheikh, Judge Chaudhry Muhammad Iqbal, Judge Tariq Salim Sheikh, Judge Asim Hafiz and Judge Muzamil Akhtar Shabir. Previously Judge Farouk Haider was included in in bench but he refused to hear the petition.
