Fate of electoral fund in limbo as NA votes against additional subsidy demand

  • Based on on no data body recommendations, the Cabinet sent a summary to the National Assembly

ISLAMABAD: National Assembly on Monday rejected the petition for release of 21 billion rupees in additional subsidy for elections to the Punjab Assembly, making fate of Supreme Court term for funds more uncertain.

According to the details, Mr. minister for Finances and Revenues Ayesha Pasha has submitted a proposal for an additional amount, not exceeding 21 billion rupees, to the federal budget. government to cover expenses during financial year but the members voted against movement.

Last week, the Supreme Court ordered the State Bank of Pakistan (SBP) to ‘allocate and release’ Rs 21 billion by April 17 (Monday) for elections in two provinces from the Federal Consolidated Fund (FCF) “under its control and administration”. the court had also ordered central bank send an “appropriate message” to this effect to the Ministry of Finance in in this respect.

A press release issued after the meeting stated that body unanimously recommended that the Finance Division consider this matter of the release of funds should be placed before the National Assembly”in form of bill through the federal cabinet” in compliance procedure with decisions of the highest court.

“The federal cabinet sent a summary to the Treasury Department based on on recommendations made NA Standing Committee on Finance and income on security of funds to the election commission for elections in Punjab and KP to Parliament,” reads a fact sheet issued by the Prime Minister’s Office.

Formerly Standing Committee of National Assembly on Finance and income also discussed issues of the electoral fund under the chairmanship of Qaisar Ahmad Sheikh.

Acting Governor of the State Bank Seema Kamil told the committee that the Supreme Court in its notice had asked the State Bank about money in accounts of federal government.

SBP in his reply told the Apex court that “we can only allocate funds, not allocate them to ECP”, adding that the funds will remain in account after distribution and the Electoral Commission may use these funds after approval of Ministry of Finance.

Member of Assembly Khalid Magsi said that who is the authority spend tax money of V people except for parliament.

Committee member Musa Gilani told SBP officials that you would be liable if you spend money without approval of V parliament.

Minister of State for Finance, Ayesha Gos Pasha in briefing for the Standing Committee on Finance, said that the State Bank has no authority spend money without approval of parliament and what issue of the release of funds will be transferred today to the federal cabinet, from where, after approval, the case will be transferred to national assembly.

She said that decision submit a resume on V issue of release of funds of 21 billion rupees to the federal cabinet on Monday itself.

Member of Barjis Tahir committee stopped Federal Minister of Justice Azam Nazir Tarar from holding a briefing on orders of Supreme Court hold elections in Punjab and Khyber Pakhtunkhwa.

Barjis Tahir said that the elections in Punjab will be harmful for country, because who wins in Punjab, will win in the other three provinces and the same party will rule in Azad Kashmir and Gilgit-Baltistan too.

The Minister of Justice stated that the costs twice for for the sake of of elections are not in interest of country, while the National Assembly already rejected demand for release of funds.

Barjis Tahir said it would against law for State Bank releases funds for holding elections.

In this regard, the Minister of Justice said: issue of release of court-ordered funds should be brought before the National Assembly, because the constitutional method for pay of funds must be accepted, otherwise who will be held accountable for funds of 21 billion rupees tomorrow.”

He said that if the state bank issues funds, will they (the state bank) be deducted from the salaries of officers? in V future or will the governor give National Bank?

Because tomorrow the question may arise that the constitutional procedure for release of funds were not accepted or perhaps the legal issue was ignored in the court orders.

Law minister said: “We say that the costs should be transparent and in correspondence with Constitution.”

Attorney General Mansour Usman Avan during a briefing at the meeting stated that one method may be that the costs of elections are deducted from other expenses.

The Attorney General reported that the Supreme Court stated that the former post actual approval should accepted after disbursement. However problem is that if the National Assembly does not approve the funds by June 30, then who will responsible for 21 billion rupees.

The Prosecutor General said that if such a situation occurs, problem may arise in in this respect. He said that one option take the former post actual approval of funds of the National Assembly as final OK of facilities with National Assembly.

On this occasion the minister of State for Finance said they were following instructions of The Supreme Court, stating that all institutions are required to comply rules.

The Minister of Justice said that the Supreme Court stated that the former post actual resolution should be accepted.

To this, the Attorney General said that if the National Assembly did not approve, then his former post asserting a fact becomes difficult.

The Attorney General suggested that it would have been better if approval had been obtained from the National Assembly.

Minister of State for The Ministry of Finance said that we would send a summary to the federal cabinet in in this respect.

Chairman of Committee Qaiser Ahmed Sheikh said that the consensus in committee is that it issue should be brought to the National Assembly through the ministry of Finance.

“No Authenticity Without Parliament’s Approval”

In a short conversation with journalists after the end of the sitting of the NA commission up today, minister of State for Doctor of Finance and Revenue Aisha Gaus Pasha stated that neither the SBP nor the Finance Department has the authority to release funds from the FCF.

She explained that the process of distribution required parliamentary approval. “No approval of parliament, no bill, no budget has any legal validity.

She clarified that the SBP can only distribute money but cannot publish it until the Finance Department gives proper direction.

“The finance department can only act on orders of federal cabinet. Now the federal cabinet wants to refer the matter to Parliament… if Parliament says Yes, today we will issue funds, ”Pasha added.

This also instructed the SBP to submit record and details of all the money of federal government lying with or under the control, guardianship or management of V bank.

After in- cameral hearing, the court ruled in to which he ordered the SBP to release 21 billion rupees from the FCF. for elections.

“Sum of 21 billion rupees will be and will be available to and with election Committee in immediately released and used funds for goals of conducting general elections to the Punjab and KP assemblies,” the court said in the ruling.

Court also noticed that required funds can be made available to the electoral commission of Pakistan (ECP) “Immediately and as soon as possible of day”. This also noted that “absolutely difficulty or a hitch, or financially or procedurally or in terms of appropriate powers under the Constitution” in immediate release of funds in question.
