Expert clarifies the implications of lifting immunity from a Jordanian MP accused of smuggling

Today, Sunday, new developments took place in the case of Jordanian MP Imad Al-Adwan, as the Israeli security authorities decided to release him after his arrest on charges of smuggling arms and gold from Jordan to Palestine.

Raise immunity

In this regard, Ahmed al-Safadi, Speaker of the Jordanian Parliament, said that the decision to lift Imad al-Adwan’s immunity was taken after a request from the prosecutor’s office of the State Security Court, noting that the parliament, in turn, voted to remove the immunity of the deputy.

He added during a press conference that Imad Al-Adwan entered Jordanian territory thanks to the efforts of King Abdullah II, Jordanian diplomacy, government, military and security services.

At the same time, he stressed: “We trust Jordan in our fair and impartial judiciary.”

State Security Court

For his part, Professor of Constitutional Law at the Jordan University School of Law and legal expert Leith Nasraween explained that Imad Al-Adwan will be tried in the State Security Court after the State Security Prosecutor’s Office investigates and files criminal charges against him in connection with the deeds.

Nasraween reported to Al-Arabiya.net/Al-Hadath.netthat the MP will be brought before the Court of State Security, and if a final judgment is passed against him to imprison him for more than one year, his membership will be forfeited in accordance with article 3/75 of the constitution.

Temporary Immunity

It is noteworthy that parliamentary immunity is considered to be the suspension of the provisions of criminal laws in relation to crimes committed by a representative during a meeting of the Council, and the possibility of being held accountable for this.

Therefore, the constitutional legislator treated it as a temporary immunity, which is valid only during the session of the Parliament, and excludes from its application the case of detention of a representative at the time of the commission of a criminal offense.

Article 86 of the Jordanian Constitution prohibits the arrest or prosecution of any MP during a meeting of the Council, unless it is decided by an absolute majority that there are sufficient grounds for his arrest or trial. Therefore, a vote is being taken to lift his immunity in the event of any request from the Jordanian courts.

Notably, Jordan announced last April that Israel had arrested Imad al-Adwan for questioning amid an alleged smuggling operation.

The Jordanian Ministry of Foreign Affairs said it was working in cooperation with concerned departments in the Kingdom to get to the bottom of the problem and “resolve it as soon as possible.”
