ISLAMABAD: At the time of comment on latest project of legislation to amend the Supreme Court Rules 1980, senior advocate of Supreme Court Safdar Shaheen Pirzada called the proposed bill against V basic compound of Article 191 of Constitution, saying what it could be set aside if he was attacked in the high court.
Speaking to TLTP, Pirzadeh said that the Supreme Court was formed in accordance with the Constitution. of Pakistan instead of any act of parliament by adding a law of Parliament is subject to the Constitution of Pakistan as a constitution is the supreme law.
Pirzada also said that in accordance with the Constitution of Pakistan, the sun is authorized to make its own rules subject to consent of the president of Pakistan. SC concluded power of Suo Moto by Supreme Court Rules instead of any act of parliament.
“According to the Constitution of Pakistani rules can only be set by the Supreme Court for run his steering wheel of affairs. Since the proposed law seems in conflict with Article 191 of A constitution that the highest court can overturn down”, Pirzada added.
“If the proposed bill becomes a law of parliament – to be considered against V basic compound of Constitutional norm (Article 191) – on this is the only reason, this amendment should be set aside if someone challenges before the highest court,” concluded Pirzade.
