Islamabad court rehearses plea for Judicial arrest of Shahbaz Gill in case of rebellion

  • Sessions court takes up review plea per order of Supreme Court of Islamabad.

Islamabad District and Session Court on Wednesday took up in review plea application for detention of PTI senior leader Shahbaz Gill in mutiny case filed against him, according to the order of Islamabad High Court (IHC).

IHC instructs the judge of the court session to rehear the case over in governments plea dismissal appeal of Gill’s physical arrest duty magistrate.

Gill’s lawyers Salman Safdar and Faisal Chaudhry appeared. in court while Judge Zeba Chaudhry listens plea.

At the beginning of At the hearing, Special Prosecutor Rizwan Abbasi told the court that a judicial magistrate had placed Gill in police custody. for two days, but the investigator demanded for extension in arrest.

After finishing of arguments special the prosecutor, Gill’s lawyer Salman Safdar made arguments. He claimed that the matter against Gill founded on bad faith and political revenge because he mentioned names of nine PML-N leaders including Maryam Nawaz, Ayaz Sadiq and others.

He complained that certain aspects of the foundation of asking for detention secret while the case record no protection provided.

He said it was necessary to find out why the police want Gill is to be taken into custody.

“Case filed on in selection of words and speech […] and the police have a speech.”

He also objection over admissibility of case, saying that the applicant is a Justice of the Peace who filed a case on on behalf of of bureaucracy and the army, but a treason case cannot be brought without permission of federal government.

In addition, he said that the sections introduced in happening of death penalty and life imprisonment, asking “whether these sections apply on such a speech.

“Jill made a little wrong statements, but anything can be wrong but they are not subject to betrayal or criminal conspiracy,” he said.

Gill’s lawyer also claimed that Gill had been taken into custody for three days and the request did not turn down immediately. He said that IO failed to complete investigation in three days, while the forensics department sent reports within 24 hours.

Gill was arrested last Tuesday afternoon from Banigal Chowk in the capital a day after the scandalous remarks on a private TV channel. It was subsequently booked on accusations of mutiny and incitement of participants of state institutions against pakistani army.
