IHC directs court sessions for hearing plea for Today physical imprisonment of Shahbaz Gill – Pakistan

Islamabad High Court (IHC) on Tuesday referred to plea seeks physical detention of PTI leader Shahbaz Gill in case of sedition in court for hearing, declaring the complaint admissible.

AT development comes less than a week after the District and Sessions Court denied a police request to extend Gill’s two-day physical detention and the Additional District and Sessions Judge (ADSJ) denied plea looking for review of district court ruling.

BUT plea a challenge to these orders was filed by the Advocate General of Islamabad, Jahangir Khan Jadun. in high court on Saturday last a week.

Make legal, not political arguments: Judge

At the beginning of At the hearing, Judge Farouk prohibited Gill’s lawyers from talking about political issues after they made some political references.

“Give legal, not political arguments in this case,” he told lawyers.

Although the judge acknowledged that the case concerned politician, he said personality of the suspect was “useless” to the court. Court only concerned with legal issues, he said.

Judge Farouk then looked for arguments on maintainability of in review a motion that was previously denied by the ADSJ.

“The case ends when the suspect is in custody. in judicial detention,” he noted, adding that sending a suspect on physical confinement in police custody was “serious business”.

The judge said it was up to the session court to determine if there was an order from a judicial magistrate to deny the police request for extension in Gill’s physical conclusion was correct.

“I will not get into the heart of the matter at this point. first hear arguments on in [review] maintainability of the petition,” he said.

When Gill’s lawyer pointed out out that the authorities filed a petition for Gill’s physical conclusion in also IHC, Judge Farooq observed that the high courts did not pass sentences.

“The High Court has no power to consider for how long suspect must be taken into custody. Regardless of how serious crime, it’s a judicial magistrate who makes a decision on detention,” he said.

“Currently I only hear arguments on maintainability of in plea in session court.

plea for FIR suppression against jill

Separately, Judge Farouk also heard plea seeking the abolition of in first information report (FIR) against jill in connection with his remarks during Ahri News bulletin.

Presenting your arguments on in plea, Gill’s lawyer, Shoaib Shaheen, argued that the case against leader PTI was founded on “bad faith”.

He claimed that approval for the charges on which Gill was prosecuted were to be dropped from government but they didn’t.

After the transcript of Gill’s remarks during Ahri News ballot was presented to the court, his lawyer further argued that only part of the PTI leader’s statement was cited to in case and what context of these remarks were not explained.

He also mentioned the case against Attorney Imaan Zainab Mazar-i-Khazir Pakistan Army for allegedly “abuse and slander of senior team” of institution.

“This case was brought not at the behest of the JAG branch, but because of in government,” the lawyer said. He added that recent statements by federal ministers were more critical than Gill and Mazar Khazir.

Following his arguments, Judge Farouk adjourned the hearing until next a week.

Gill’s controversial comments

On August 9, the Pakistan Electronic Media Regulatory Authority (Pemra) released show-cause notification Ahri News for broadcasting Gill’s comments, which he said were “highly hateful and inflammatory” remarks tantamount to “inciting the armed forces to rebellion”.
