ISLAMABAD: Supreme Court on Friday asked how whether a member of the federal cabinet could amend in his favor and instructed government submit details of cabinet members whose names were removed from the output control list (ECL).
Judge’s observation of The Supreme Court consisted of five people bench of The Supreme Court resumed hearings on suo motu notification on alleged fear of “persons in authority, undermining criminal justice system.
Supreme Court also looking for a report on method of amendments in ECL rules and summoned the director of the Federal Legal Investigation Agency, Ousmane Gondal.
“Currently, the court does not invalidate decision regarding amendments in OKU rulessaid CJP Umar Ata Bandial.
The court later adjourned the case indefinitely.
During the hearing, the chief judge said the high court would take action against anti-state steps.
He appealed to the Attorney General of Pakistan (AGP) Ashtar Awsaf delivered Section 2 of ECL rules under which terrorists, tax evaders and loan defaulters cannot travel out of country.
“By whose order did the Cabinet of Ministers amend rules related to people involved in corruption and defaulters. The Federal Cabinet approved the amendment in rules? CJP asked.
Answering the question, AGP Ausaf said that he would submit the protocol of cabinet meeting for OK.
Meanwhile, Judge Ijazul Ahsan asked if the name would be removed off-road list after 120 days on your own?
To this the AGP replied that rule of 120 days will apply after enabling of name in in list.
Judge Mazahar Naqvi was of in view that Cabinet members took advantage of the amendment they approved.
“How members of the Cabinet of Ministers could amend for their personal gain,” the judge asked.
AGP claimed that he would find out if members who we in don’t travel list were part of the committee approved the amendments or not.
Judge Munib Akhtar said the court is aware that the federal ministers only have allegations and nothing has been proven. against them.
“But is there any code that can guarantee that the file of the case is not referred to the same minister who accused in this,” he asked.
Meanwhile, Judge Mazhar noticed how a minister facing statements may amend rules to benefit yourself.
“Amendments in OKU rules canceled the procedure review. Isn’t that the approval of the Cabinet for amendment conflict of interest, he asked.
Judge Naqvi noted that the person advised by Azam Nazir Tarar benefited.
The judge inquired about the procedure that was adopted to amend the ECL rules.
