government challenges IHC order on Discontent of Baloch students – Pakistan

ISLAMABAD: federal government challenged the ruling of the Islamabad High Court (IHC) dated April 28, according to which for formation of complaints commission of harassment of Baloch students.

Moved by the Interior Ministry to the Supreme Court on On Wednesday, the appeal sought a directive from the higher court to suspend the solebench order from IHC Chief Justice Athar Minallah on petition of human rights activist Iman Zaynab Hazir Mazari over alleged persecution of Baloch students.

According to the petitioner, the students from Balochistan were facing harassment in Quaid-i-Azam University and other educational institutions throughout the country.

The students claimed they were subjected to “racial profiling” and enforced disappearances by law enforcement.

federal government argued in his appeal that the ruling of the higher court had no effect because it was based on “Misreading and not reading of in record”, as well as “incorrect application of law”.

The appeal argued that because the IHC directive was final order in moderation of meeting of commission, it “exceeded its territorial jurisdiction” by appointing body consider complaints of students about the “lack of security, racial profiling and enforced disappearances” during a visit to their home cities in Balochistan.

The decision of the Supreme Court was arbitrary in nature and, based on the hypothesis, government argued, arguing that it was not sustainable under the law.

“IHC has no right to entertain and pass such orders. So he can be set aside.”
