Islamabad: The supreme court on Thursday issued a notice to prime minister on moved a petition in 2015 by the then speaker of the National Assembly Ayaz Sadiq against his dismissal by the Electoral Commission of Pakistan (ECP) as a member of the House.
Sadiq was re-elected at home in October 2015, months after an electoral court dismissed him as MP from NA-122 (Lahore-V) on charges of irregularities during the 2013 elections in which he had defeated Imran Khan, defeating Abdul Aleem Khan of PTI from a strait lead of about 4,000 votes.
The court had also imposed a fine of Rs 2.5 million on the parliamentarian of the Pakistan Muslim League-Nawaz (PML-N). who then he went to the Supreme Court against the judgment.
In his appeal filed with the Lahore registry of Supreme Court, Sadiq had argued that the contested court order was against the facts of the case and the laws governing the electoral process.
The petition had been pending ever since.
On Thursday, after nearly seven years, a three-seat judge led by President of the Supreme Court Umar Ata Bandial, took up the request is sent notice to prime minister.
During the hearing, the bench noted that the case was related to the 2013 election, adding the term of those polls were over in 2018. To this, Sadiq’s counsel he said his client was fined.
Subsequently, the court issued notices to the ECP and the National Database and Registration Authority (Nadra), ordering them to pay for expenses incurred during the ballot of record.
